Another Court Dismisses a Copycat Lawsuit

There is finally some encouraging news for real estate professionals.

A U.S. District Court in the Western District of Pennsylvania recently dismissed an antitrust lawsuit against the National Association of REALTORS® (NAR), along with the Pennsylvania, New Jersey, and New York state REALTOR® associations.

According to RISMedia, this dismissal is one of several recent legal victories that reinforce the independent structure of local, state, and national REALTOR® associations. It also continues a growing trend of favorable rulings for NAR throughout 2025.

Perhaps the biggest takeaway?

These copycat lawsuits are not proving to have nine lives.

In fact, this marks the sixth copycat lawsuit dismissed over the past year, signaling that courts are increasingly scrutinizing these repetitive legal claims rather than allowing them to move forward.

The Judge's Decision

The court made its position clear.

"Plaintiffs' motion for preliminary injunction as to Defendant NAR is denied for the same reasons previously stated on the record."

While every lawsuit is unique, this decision adds to a growing list of cases where courts have declined to allow similar claims against NAR to proceed.

What Are "Copycat" Lawsuits?
